Pupgress — Terms of Service
Welcome to Pupgress. These Terms of Service ("Terms") are a legal agreement between you and Pupgress ("Pupgress," "we," "us," or "our") governing your use of the Pupgress website, application, and services, including our AI dog-training assistant, "Koa" (collectively, the "Service"). By creating an account, starting a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. What Pupgress Is
Pupgress is a subscription-based dog-training service. After completing a short quiz about your dog, you receive a personalized training plan and access to Koa, an AI trainer you can message for guidance about your dog's behavior and training.
2. Eligibility and Accounts
You must be at least 18 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity that happens under your account. Please provide accurate information and keep it up to date. Notify us at support@pupgress.com if you suspect unauthorized use of your account.
3. Subscriptions, Billing, and Auto-Renewal
Pupgress is offered on a paid subscription basis. Current plans and prices are:
- Monthly: $29.99 per month
- Quarterly: $59.99 every three months
- Annual: $149.99 per year
Prices are in U.S. dollars and may be shown with applicable taxes at checkout. Payments are processed by our third-party payment processor (Stripe). By subscribing, you authorize us to charge your selected payment method for your chosen plan.
Automatic renewal. Your subscription renews automatically at the end of each billing cycle at the then-current price for your plan, and your payment method will be charged, unless you cancel before the renewal date. Auto-renewal continues until you cancel.
Discount and promotional codes. We may offer discount codes or free-access codes (including through partners such as dog daycares, breeders, and veterinarians). Discounts apply as described at the time of the offer, generally to a first billing period unless otherwise stated, and may not be combined with other offers unless we say so.
Price changes. We may change subscription prices. If we do, we will give you reasonable advance notice, and any change will apply to your next billing cycle. Continuing to use the Service after a price change takes effect means you accept the new price.
4. Cancellation and Refunds
Cancel anytime, in one place. You can cancel your subscription at any time through your account settings ("Manage Billing"), which turns off auto-renewal. When you cancel, you keep access to your paid features until the end of your current billing period, and you will not be charged again after that. We do not use hidden cancellation steps.
7-day free trial. New subscribers start with a 7-day free trial. You will not be charged during the trial, and you may cancel at any time before it ends to avoid being charged. If you do not cancel before the trial ends, your paid subscription begins automatically at the then-current price. Except as required by law, payments are final and non-refundable, and we do not provide refunds or credits for partial billing periods.
App store purchases. If you subscribe through a third-party app store (such as the Apple App Store), that store's billing, cancellation, and refund policies also apply, and you may need to manage or cancel that subscription through your app store account settings.
5. Your Content and Conduct
You may submit information, messages, and photos of your dog to the Service ("Your Content"). You keep ownership of Your Content. You grant Pupgress a limited license to use, store, and process Your Content solely to operate and improve the Service (for example, so Koa can give you personalized guidance and remember your dog's context).
You agree not to misuse the Service, including by: using it for anything other than training and caring for your own dog; attempting to access other users' data; attempting to reverse-engineer, overload, scrape, or disrupt the Service; using Koa to generate content unrelated to dog training or to bypass its intended purpose; or using the Service for any unlawful purpose. We may limit, suspend, or terminate accounts that abuse the Service, including automated or excessive usage.
6. Intellectual Property
The Service, including Koa, the Pupgress name and branding, the training content, software, and design, is owned by Pupgress and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use while your subscription is active. You may not copy, resell, or redistribute the Service or its content.
7. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not guarantee any specific training results, and outcomes depend on many factors outside our control, including your dog and how the guidance is applied. As stated above, the Service is not veterinary or medical care.
8. Limitation of Liability
To the fullest extent permitted by law, Pupgress and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service, including any reliance on training guidance. To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.
Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits rights you have under applicable consumer-protection laws.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms with a new "Last updated" date or notifying you). Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree, you should stop using the Service and cancel your subscription before the changes take effect.
10. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in California, and you agree to that jurisdiction. This does not override mandatory consumer-protection rights available to you under the laws of your own state or country.
11. Koa Live (Real-Time Video Coaching)
Koa Live is an optional premium feature that provides real-time, camera-based training guidance. It is training guidance only, and is not veterinary, medical, or professional behavioral care. By using Koa Live you agree to the following, in addition to the rest of these Terms:
(a) You are responsible for safety. You are solely responsible for your own safety, your dog's safety, and the safety of any person or animal nearby during a session. Training involves inherent physical risk, including risk of injury to people, dogs, other animals, and property.
(b) Safe use. Keep audio at a comfortable volume, especially with earbuds. Stay aware of your surroundings and do not train near traffic, stairs, water, or other hazards. Do not use Koa Live while driving or operating machinery or vehicles.
(c) Stop and seek help. If your dog shows aggression, fear, pain, injury, or distress, stop the session immediately and contact your veterinarian or a certified behaviorist (such as an IAABC consultant or veterinary behaviorist).
(d) AI limitations. Koa is an AI system. It can be wrong, misinterpret the video, or miss things. You must use your own judgment and not rely solely on Koa Live.
(e) Camera, microphone, and data. During a session, your video and audio are streamed to our AI provider to power the coaching, and your audio is transcribed to generate a short text summary of the session. We retain that summary to support your training progress. We do not store the session video, the session audio, or the raw transcript.
(f) Eligibility. You must be at least 18 years old to use Koa Live.
(g) Assumption of risk, release, and limitation of liability. To the fullest extent permitted by applicable law, you assume all risks associated with Koa Live and use it at your own risk. To the fullest extent permitted by law, Pupgress and its owners, employees, and affiliates will not be liable for any injury, loss, or damage, whether direct or indirect, arising out of or related to your use of Koa Live, and you release them from all such claims. This Section is in addition to, and does not limit, Section 8 (Limitation of Liability). Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.
(h) Acceptance. You must affirmatively accept these Koa Live terms before your first session. We record your acceptance, including the version accepted and the date. If we materially change these terms, we may require you to accept the updated version before continuing.
