1. Acceptance of Terms

By accessing or using Pupgress ("the Service," "we," "us"), operated by Pupgress, you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Pupgress is a web-based subscription software application providing personalized dog training plans, progress tracking, and an AI-powered training assistant ("Koa"). Pupgress is an educational and training tool only. It is not:

Veterinary care or medical advice
Professional animal behavioral therapy
A substitute for in-person certified dog training or behaviorist services
A guarantee of any specific training outcome

If your dog shows signs of aggression, resource guarding, or any behavior that may pose a safety risk to people or animals, you must consult a certified professional dog trainer or applied animal behaviorist (e.g., CAAB, IAABC-certified) in person. If your dog shows signs of illness, injury, or sudden behavior change, consult a licensed veterinarian before pursuing training changes.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use Pupgress.

4. Subscription Plans & Billing

Pupgress offers Monthly, Quarterly, and Annual subscription plans, billed in advance via Stripe.
Subscriptions automatically renew at the end of each billing period at the then-current price, unless cancelled before the renewal date.
You authorize us to charge your chosen payment method on a recurring basis until you cancel.
Prices and plans are displayed in full before you complete purchase.

5. Cancellation

You may cancel your subscription at any time through the "Manage Subscription" link in your account or the link provided in every billing/renewal email, without contacting support.
Cancellation takes effect at the end of the current billing period; you retain access until then. No partial-period refunds are issued for standard cancellations (see Section 6 for the money-back guarantee).

6. 7-Day Money-Back Guarantee

If you are not satisfied within the first 7 days of your initial paid subscription, contact us at support@pupgress.com for a full refund, no questions asked.
Refund requests made within this window are processed the same business day.
This guarantee applies to a customer's first subscription purchase only, not to subsequent renewal charges.

7. AI Trainer ("Koa") Disclaimer

Koa is an artificial intelligence assistant, not a licensed veterinarian, animal behaviorist, or certified trainer.
Koa's guidance is general, force-free/positive-reinforcement training information and may not account for every individual circumstance.
Koa is programmed to refer you to a certified professional or veterinarian for aggression-related, safety-related, or medical concerns, and will decline to provide DIY guidance in those situations.
You use Koa's guidance at your own discretion and risk. Pupgress is not liable for outcomes resulting from your reliance on AI-generated guidance.
Fair-use limits apply to chat usage (currently up to 50 messages/day) to maintain service quality for all users.

8. User Content

Any content you submit (photos, chat messages, progress notes) remains yours, but you grant Pupgress a limited license to store, process, and display it back to you within the Service, and to use anonymized/aggregated data to improve the Service.

9. Prohibited Uses

You agree not to: misuse the AI chat to seek harmful advice for humans or animals, attempt to circumvent rate limits or security controls, resell or redistribute Service content, or use the Service for any unlawful purpose.

10. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud/chargebacks, or abuse the Service (including excessive AI chat abuse beyond fair-use limits).

11. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. PUPGRESS DOES NOT GUARANTEE ANY SPECIFIC TRAINING RESULT, TIMELINE, OR OUTCOME. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUPGRESS'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID IN THE 3 MONTHS PRECEDING THE CLAIM.

12. Changes to Terms

We may update these Terms from time to time. Continued use after changes constitutes acceptance. Material changes will be notified via email.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
